GENERAL PROVISIONS
Accenthealth.com (the "Service") is an online information and communication service provided by AccentHealth and contains information from various content providers, including but not limited to Healthwise Incorporated, WellMed, Inc., American Self-Help Clearinghouse, Multum Information Services, Inc., National Cancer Institute, Nord's Rare Disease Database and the New York Times ("Suppliers"). As used in this Accenthealth.com User Agreement ("Agreement"), "We", "Us" or "Our" refers collectively to AccentHealth. "You" or "User" refers to You, the user of this Service. "Software" includes all software that comprises the Service or is used to interact with the Service, and include all software provided by Our Suppliers.
We reserve the right to modify the terms and conditions of this Agreement at any time, and such modifications shall be effective immediately upon posting the modified Agreement. You agree to review this Agreement periodically to be aware of such modifications and Your accessing or using the Service constitutes your acceptance of the Agreement as it appears at the time of Your access or use. We hereby grant You the right to view and use this Service and the Software subject to the terms and conditions of this Agreement. You may use the Software for your own personal use and only through links from the Service's or Our Supplier's websites.
The information contained in this Service and the Software is based on current medical literature and on physician review; however, such information is not intended nor implied to be a substitute for professional medical advice. Nothing in this Service or the Software, or the use thereof, is intended to be used for, or replace, the advice of a doctor, medical diagnosis or treatment. The Service and all Software are provided "AS IS". We and our Suppliers make no representations or endorsement about the suitability of Software, products and services or the timeliness or accuracy of the information available through this Service for any purpose. Nor do We or our Suppliers warrant that the functions contained in the Software will meet your requirements, or that the operation of the Software will be uninterrupted or error-free, or that defects in the Software will be corrected. WE AND OUR SUPPLIERS DISCLAIM ALL WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH REGARD TO THE PRODUCTS, SERVICES AND INFORMATION CONTAINED ON OR MADE AVAILABLE THROUGH THIS SERVICE OR THE SOFTWARE. While We and Our Suppliers attempt to keep the information and resources available on this site both timely and accurate, AccentHealth and its Suppliers do not warrant the accuracy, reliability, completeness or correctness, timeliness or usefulness of any opinions, advice, Software, services, merchandise or other information provided through the Service or on the Internet generally, or that the Service or the Software will meet your requirements.
You understand that We and Our Suppliers cannot and do not guarantee or warrant that files available for downloading through the Service or the Software will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. We do not assume any responsibility or risk for, and You expressly acknowledge and agree that, use of the Service or the Software is at your sole risk.
To the maximum extent permitted by applicable law, in no event shall We or Our Suppliers be liable for any direct, indirect, special, punitive, incidental, exemplary or consequential damages, or any damages whatsoever, resulting from any loss of use, loss of data, loss of profits, business interruption, litigation, or any other pecuniary loss, arising out of or in any way connected with the use or performance of this site, with the delay or inability to use this site or with the provision of or failure to make available any information, services, products, materials or other resources contained on or accessible through this Service, even if We or Our Suppliers have been advised of the possibility of such damages.
You are solely responsible for the content of Your messages and postings on this Service. As a condition of Your use of this Service, You warrant to Us that You will not use this Service for any purpose that is unlawful or prohibited by this Agreement. You may not post or transmit any message which is libelous, defamatory or which discloses private or personal matters concerning any person. You may not post or transmit any message, data, image or program which is indecent, obscene, pornographic, threatening, abusive or hateful. We reserve the right to take such action as it deems appropriate in cases where the Service is used to disseminate statements that are, in our judgment, offensive or harmful.
The materials on this Service and the Software are copyrighted by Us or by the respective Suppliers. You may download and/or print a copy of information provided in this Service for Your personal use only. In addition, subject to any Supplier-specific prohibitions as indicated in the Supplier-Specific Terms and Conditions below, You may "clip and send" content contained on the Service or the Software to Your doctors and other healthcare professionals used by You. Any copied content must include the appropriate disclaimers and proprietary marks for Us or the applicable Supplier.
Except as specifically provided to the contrary in this Agreement, You expressly acknowledge and agree that no right is granted to You to copy, modify, alter, revise, paraphrase, omit, change, display, store, timeshare, rent, lease, sublicense, publish, distribute, transmit, transfer, assign, sell, or commercially exploit in any manner whatsoever the Software. Permission to reprint or electronically reproduce any document or graphic in whole or in part for any purpose not set forth in this Agreement is expressly denied, unless prior written consent is obtained from the respective copyright holder(s). All marks displayed on the Service or in the Software are Our or Our Supplier's trademarks (both registered and unregistered). No right, license or interest to such trademarks is granted to You under this Agreement. You agree that no such right, license or interest shall be asserted by You with respect to such trademarks.
SUPPLIER-SPECIFIC TERM AND CONDITIONS
In addition to the general provisions, the following terms and conditions relate specifically to content (both software and written or graphic content) provided by the identified Supplier:

NOTICE The materials contained in Health Profile and Health Quotient (HQ) are for educational purposes only. They are not intended to be used for medical diagnosis, medical treatment or to replace evaluation by a qualified physician. WellMed, Inc., the developer of Health Profile and HQ, strongly recommends that all individuals consult with a physician before starting any diet or exercise program.
DISCLAIMER OF WARRANTY WellMed, Inc. makes no warranties, express or implied, with respect to HQ or its quality, performance, merchantability or fitness for any particular purpose.
HEALTH PROFILE AND HQ ARE LICENSED AND DELIVERED AS IS Users of HQ maintain complete responsibility for the accuracy and appropriate application of this product for their intended purpose(s).
LIMITATION OF LIABILITY In no event shall WellMed, Inc. be held responsible nor liable for any indirect, direct, incidental, special or consequential damages or costs whatsoever resulting from or related to the use or misuse of Health Profile and HQ, even if WellMed, Inc. has been advised, knows or should be aware of the possibility of such damages.
PRIVACY, CONFIDENTIALITY, SECURITY Health Profile is a private matter. WellMed has taken steps to keep it that way. WellMed's Privacy Statement: WellMed will never willfully disclose your individual information to any employer, insurer, physician or other health care professional, family member, or anyone else, unless you expressly authorize WellMed to do so. This applies to any information you may entrust to us, whether the information is medically-related or not.
Self-Help Clearinghouse
By retrieving and/or utilizing information from the American Self-Help Clearinghouse database, you agree to hold harmless American Self-Help Clearinghouse, its owners and employees from any and all liability arising directly or indirectly from your use of information contained in the database. You be the judge. The Self-Help Clearinghouse does not evaluate or rate the individual self-help groups which are contained in the database. Therefore, Self-Help Clearinghouse's listing of a self-help group does not constitute an endorsement of that group. Neither does omission signify disapproval. We include groups in our database based upon a report of their organizations as being focused upon no-fee mutual aid, i.e., members helping one another. The use of any information is entirely the responsibility of the reader. You are the ultimate judge in deciding whether the group is appropriate to your needs.
